The Department of Finance recognizes that members of the public have the right to choose whether to represent themselves or rely on the services of a broker. While we will not endorse or recommend a particular broker, it is our obligation to inform the public when a broker has been found guilty of unethical conduct in the performance of his or her duty. If you attended an in-person hearing, you may request a transcript of the hearing record for your appeal.
You are responsible for paying the cost of the transcript. You will be informed of the cost of the transcript within seven business days from our receipt of your request.
If you submitted your request online, we will notify you of the cost by email; if you submitted your request by mail, we will notify you by mail. You must include a copy of your transcript request with your check. If payment is not received by that time, your transcript request will be denied and your appeal will go forward as scheduled. No further transcript requests for your appeal will be accepted.
Please note that the Department of Finance does not currently charge an administrative fee for transcript requests and will not do so until such time as the agency updates its rules or revises its procedures. All car parks and roads with parking restrictions must have signs or road markings that make this clear. Your ticket should be cancelled if you can prove:. Some car parks and bays have a sign saying not to park there if there's no way to pay.
If where you parked had this sign, your appeal is likely to be rejected. You can usually get a discount for paying your ticket early, so you might want to do this instead of appealing.
The lower band is for something less serious, like parking for longer than your ticket allows. You can find out how much a council charges for each band on their website. An Abandoned Vehicle. Broken Parking Meters. Damaged Signs. Faded Curb Zones. Submit Other Complaints. Private off-street parking is generally governed by the law of contract.
If you park in a private off-street area and do not adhere to the rules the operators have advertised on local signs and notices, you may be issued with a Parking Charge Notice.
An Approved Operator will give you time to assess the advertised rules, known as terms and conditions, and you are free to leave the parking area if you disagree with them. If you stay then you will have legally agreed to abide by them. Most drivers issued with a parking ticket have the right to contest it, but the process varies depending on where and when it was issued and by whom. You MUST follow the process as outlined in the ticket received and decide whether to accept the charge or appeal.
If you decide to appeal, contact the local authority or organisation who issued the Penalty Charge or Parking Charge telling them why you think the charge should be cancelled. If they agree, that is the end of the matter. If they reject your representations or appeal, they will tell you what you can do next. You will normally be given information about an independent appeals service.
